How your property settlement works

Your property settlement runs from the day your offer is signed to the day you get the keys. Here's what happens along the way, and what we do for you at each step.

1.

Send us your signed offer

Once your offer and acceptance is signed, email it to us. We'll open your file, confirm your fixed fee in writing and introduce you to your settlement agent.

2.

We get the groundwork done

We contact the other side, order title and council searches, and note every key date in your contract, such as finance approval and building inspection deadlines.

3.

We keep your conditions on track

We'll remind you before each deadline and chase what's needed, so nothing slips through the cracks.

4.

We prepare for settlement

We complete the transfer documents, organise stamp duty (for buyers), work out rates and taxes adjustments, and send you a settlement statement.

5.

Settlement day

We settle electronically through PEXA and let you know the moment it's done. For buyers, that means the keys are yours. For sellers, your funds are on their way.

Why choose a settlement agent backed by lawyers?

Most settlements run smoothly. But when something unexpected comes up, it helps to have legal advice close at hand.

Lotus Settlements is part of Lotus Legal, so if your settlement needs more than a settlement agent can offer, our lawyers can step in without you having to start again somewhere else.

Building defects

Your building inspection finds a structural issue. We'll explain your options under the contract and bring in a lawyer if needed.

Late settlement

The other side can't settle on the agreed date. We'll keep you informed, and our lawyers can advise you on your rights.

Changing the buyer

You want to add your partner or nominate a family trust. We'll check whether the contract allows it and handle the paperwork.

Missing inclusions

The dishwasher or garden shed isn't where you expected. We'll work through what the contract says and help sort it out.

Moving in early

You'd like to move in, or start renovating, before settlement. We'll explain the risks and put the right written agreement in place.

Family and estate transfers.

Family, separation and estate transfers often need legal advice as well as a settlement. You’ll get both under one roof.
